Context

We are currently seeking a Commercial/Contracts Manager for a portfolio of mobility/railway projects here in Saudi Arabia. You will be responsible for managing Project Contractual, Commercial and Claims Management activities.

Missions/Main Duties

Key Responsibilities:

  • Contract Management & Oversight:
  • Develop, negotiate, and manage contracts related to railway projects, ensuring that the terms align with the client’s objectives.
  • Ensure compliance with contractual obligations and proactively monitor contract performance, identifying any potential issues or risks
  • Manage amendments, change orders, and variations, ensuring that both the client's and JV's interests are fully considered and protected.
  • Provide strategic advice to the project teams on complex contract matters, including the interpretation of terms and conditions, and offer guidance on best practices.
  • Commercial Risk & Opportunity Management:
  • Identify and evaluate commercial risks associated with the project portfolio, developing strategies to mitigate these risks while maximizing opportunities for the client
  • Implement proactive risk management strategies, ensuring both client and JV obligations and liabilities are clearly defined and effectively managed.
  • Advise on the commercial implications of project delays, claims, disputes, and other contract-related issues, safeguarding the client’s interests
  • Stakeholder & Joint Venture Management:
  • Act as the primary point of contact for all commercial and contractual matters within the project portfolio, managing relationships with the client, JV partners, contractors, and other key stakeholders.
  • Maintain strong and collaborative working relationships with JV partners, ensuring effective communication and alignment of commercial objectives throughout the project.
  • Support the client in contract negotiations, ensuring fair, transparent, and mutually beneficial agreements are reached.
  • Commercial Performance & Reporting:
  • Monitor and report on the financial performance of the projects, ensuring that the client’s financial interests are safeguarded and that costs, budgets, and forecasts are aligned.
  • Prepare and present detailed commercial reports for senior management, the client, and JV partners, including updates on risks, financial status, and the progress of contract negotiations.
  • Ensure timely and accurate invoicing and payment processing in accordance with contract terms for both the client and JV.
  • Compliance & Legal Framework:
  • Ensure that all contractual and commercial activities are in full compliance with relevant regulations, laws, and industry standards, including JV-specific frameworks.
  • Promote compliance with JV governance procedures and contractual obligations, ensuring that all parties are adhering to agreed terms and legal requirements.
  • Strategic Input & Contractual Advice:
  • Provide expert commercial and contractual guidance to the JV and client’s senior leadership, ensuring that strategic decisions are informed by sound contract management principles.
  • Assess the commercial viability of new project opportunities and provide advice on structuring new contracts or other forms of agreements.
  • Stay abreast of emerging trends, laws, and market conditions affecting the railway sector, advising the client on any necessary changes or adjustments to contracts.
Profile/Skills
  • Excellent writing skills with the ability to draft and edit a variety of written reports and communications and to articulate ideas clearly and concisely.
  • Bachelor’s degree in Law, Business, Engineering, or a related field (or equivalent experience).
  • Chartered status (e.g., RICS, CIPS, or equivalent) or membership of a relevant professional body.
  • Proven experience (typically +15 years) in managing commercial contracts within the railway, infrastructure, or construction sectors
  • In-depth knowledge of railway industry standards, regulations, and contracting practices.
  • Expertise in commercial contract law, risk management, dispute resolution, and financial management.
  • Excellent negotiation, communication, and interpersonal skills, with the ability to navigate complex stakeholder relationships.
  • Outstanding leadership skills; inspiring interpersonal effectiveness to lead team, train talent and effect change; willing and able to be a "doer" and "influencer".
  • Ability to create and write contracts and request for proposals for projects work.
  • Excellent time management organization and focus on ability to priorities and multi task, with ability to focus on detail.

**Context**:
As our Infrastructure Business Line is growing we are seeking an experienced Commercial/Contracts Manager for our Oxagon project based in Duba, Saudi Arabia. The designated Commercial/Contracts Manager overall responsibility is to support the Project Director in the delivery of the project to the contractual arrangements and the required commercial outcome are in accordance with the agreed financial objectives.

**Main duties**:

- Define and implement criteria for control and management of the project.
- Monitor, review and ultimately take responsibility for the content of the project master programme. Ensure the structure of the master programme is in line with the envisaged or agreed project WBS and provide strategic guidance to the schedule formulation.
- Monitor and oversee progress status updates of the master programme and where necessary liaise with project stakeholders to lead delay mitigation strategies and improvement initiatives.
- Take an active and leading role in the control of 'time' on the project, ensuring a protocol and full review of early warnings is in place, and generally ensure a project structure, and personal ownership of changes, is implemented.
- Ensure that a formal risk management process is in place on the project, utilising agreed risk register and management process.
- Hold, chair and lead risk meeting and actively participate in formulation of mitigation and control measures. Regularly discuss risk management
- You will be mainly responsible for the commercial performance of the project
- Monitor the delivery of Contract Administration services by other, and ensure such is protecting the Client as far as possible. Pro-actively monitor this service to ensure active claims protection and management is in place through the issue of contractual correspondence and record maintenance.
- Take overall responsibility of the 'cost' element of the project, even if through the monitoring and management of a third party cost consultant.
- Ensure effective budget control is in place across the project, and that such is reviewed and updated on minimum monthly basis.
- Where applicable lead and oversee the value management strategy.
- Develop and maintain excellent relationships with client representatives, consultants, and other project stakeholders
- Monitor compliance of the Service Delivery Process throughout the project delivery phase and respond to queries
- Review monthly financial reports and review any actions in respect of the Risk Register and project contingency
- Provide guidance to project teams to ensure a consistent approach to billing in line with contractual arrangements is maintained to maximise positive cash flow.
- Influence behaviours to provide early warnings of risk to projects financial health

**Technical skills**:

- Demonstrated ability to consistently suceed in a similar role, with typically, 25+ years of relevant experience in large infrastructure projects showing increasing levels of responsibility
- Previously held a Commercial/Contracts Manager position or equivalent
- Previous experience in design delivery projects
- Shall have experience in managing and directing a large group of engineers with the responsibility to guide the technical development of the group to optimize the capability of the team and to deliver cost-effective designs in the most efficient manner.
- Manage and direct major projects successfully to budget and client specifications
- Have a Bachelor’s degree in Engineering or Construction management or equivalent
- Experience across the full project lifecycle with respect to planning, cost, and schedule control
- Good understanding of the design process and construction methodologies
- KSA or at least GCC experience is preferred

The exhibition space, totaling 491,100 m² GFA, can accommodate up to 197 participating countries and 29 international organizations. Working collaboratively with our customer, Expo 2030 Riyadh Company (ERC), Bechtel will manage the infrastructure program which comprises early works, utilities, and publicly accessible spaces like streets and parks. Our scope on the six-square-kilometer site will transition into a mixed-use legacy development to serve the community after the six-month event is over. The project’s master plan leverages international sustainability standards for urban afforestation, treated water, and energy sources.

Job Summary:

Lead on all activities associated with formation, tendering, award and administration of assigned contract packages and perform the same. Activities include delivery of critical items required from initial project set-up, through to developing a team, establishing coordinated procedures and controls, to management of team(s) with accountability for work product to project milestones, quality and safety standards. # Project Overview:
Expo 2030 Riyadh is a global platform where countries, organizations, and individuals will come together to collaborate. Under the theme "Foresight for Tomorrow," the Expo promotes sustainable development, innovation, and transformative thinking. The event will be held from October 2030 to March 2031 and is expected to welcome over 40 million visits.
The 6 km² Masterplan outlines a comprehensive framework for participation and infrastructure at the Expo. The exhibition space, totaling 491,100 m² GFA, can accommodate up to 197 participating countries and 29 international organizations. Working collaboratively with our customer, Expo 2030 Riyadh Company (ERC), Bechtel will manage the infrastructure program which comprises early works, utilities, and publicly accessible spaces like streets and parks. Our scope on the six-square-kilometer site will transition into a mixed-use legacy development to serve the community after the six-month event is over. The project's master plan leverages international sustainability standards for urban afforestation, treated water, and energy sources.

Lead on all activities associated with formation, tendering, award and administration of assigned contract packages and perform the same. Activities include delivery of critical items required from initial project set-up, through to developing a team, establishing coordinated procedures and controls, to management of team(s) with accountability for work product to project milestones, quality and safety standards.
